Ellis County

Ellis County is located in the state of TX. The county was named after Richard Ellis, president of the 1836 Constitutional Congress that declared Texas’ independence from Mexico. In 2020, the U.S. Census Bureau recorded a population of 192,455 residents.

Unfortunately, Ellis County’s extensive population has led the area to see an increased rate of drug-related arrests. Travelers are constantly passing through Ellis County, bringing in marijuana from the state of Colorado which has mostly legalized the drug. Law enforcement officers remain on the lookout now more than ever for these criminals.

Although cannabis has been legalized in some states, the state of Texas prosecutes harshly against those who possess, manufacture, or traffic marijuana. If you have been arrested for marijuana charges in Ellis County, it is critical to secure a skilled criminal defense attorney that can prepare a strong defense for your case. Don’t suffer this battle alone. Law Offices of David Sloane, PLLC can help.

Marijuana DWI Penalties in Texas

Many people believe they can only get arrested for driving while intoxicated (DWI) if they consume and become inebriated on alcohol. However, that is not the case. Operating a vehicle while impaired due to drugs such as marijuana can also constitute DWI charges in the State of Texas.

If a motorist is found guilty of operating a vehicle under the influence of cannabis for the first time, they will be charged with a class B misdemeanor punishable by up to $2,000 in fines and up to 180 days in jail. For a second marijuana DWI offense, Texas law classifies the crime as a class A misdemeanor punishable by up to $4,000 in fines and up to 1 year in jail.

Third or subsequent marijuana charges are classified as third-degree felonies. A third-degree felony in Texas is punishable by up to $10,000 in fines and 2-10 years of imprisonment.
