The First Offender Drug Program in Tarrant County
Although possession is illegal, the crime itself is nonviolent and has little to no impact on society. Legislators in Tarrant County wanted to minimize the number of people in jails for possession as the crime was relatively common and minor. So, Tarrant County created the First Offender Drug Program (FODP) in an effort to rehabilitate and treat first-time offenders charged with a drug crime rather than punish them with detention.
FODP’s brochure indicates that the program will:
- Offer the non-violent offender an opportunity to address and correct their mistakes;
- Will require minimal supervision;
- Require the participant to enter a plea of guilty to enter;
- The judge will then accept the plea and can postpone sentencing until completion of the FODP program;
- Consists of two tracks; one for misdemeanors and one for felonies;
- The program will include random drug tests, hair tests, check ins with a case manager, and a drug education or life skills class; and
- Once the program is completed the participant will have their charges dismissed.
