Is Possession of Marijuana a Felony in TX?

If an individual possesses more than four ounces of marijuana, they can be charged with a felony. The extent of the charge, however, will depend on the amount found in the person’s possession.

  • More than 4 oz. of marijuana but less than 5 lbs. — State jail felony, punishable by up to 2 years in prison and up to $10,000 in fines
  • More than 5 lbs. but less than 50 lbs. —  Third-degree felony, punishable by up to 10 years in prison and up to $10,000 in fines
  • More than 50 lbs. but less than 2,000 lbs. —  Second-degree felony, punishable by up to 20 years in prison and up to $10,000 in fines
  • More than 2,000 lbs. —  First-degree felony, punishable by up to 99 years in prison and up to $50,000 in fines

Possession of 2 oz.or less is a  Class B Misdemeanor, punishable by up to $2,000 in fines and/or up to 180 days in a county jail.

Possession of 2 to 4 oz is a  Class A Misdemeanor, punishable by up to $4,000 in fines and/or up to 1 year in a county jail.
